NY AG Schneiderman says he’ll sue on ObamaCare repeal

New York Atty. Gen. Eric Schneiderman said Friday that the Republican plan to repeal Obamacare was “unconstitutional” and that he plans to file a lawsuit if the Senate passes the bill.

“I hope it’ll never become law, I hope we’ll be able to save a lot of time and trouble and not have to bring this litigation,” he said in an interview on CNN.


Schneiderman said that the bill is drafted in a “tricky” way that would essentially wipe out the women’s-health provider Planned Parenthood. “It’s an effort to kill off Planned Parenthood, which would impose an undue burden on women’s constitutionally protected rights,” he said.

The attorney general also took aim at a provision in the bill that will let New York counties outside the Big Apple off the hook for state Medicaid costs — which he claims is also against the Constitution.

“There is no legitimate federal interest in interfering with that — it’s just an effort by some New York congressmen, they wanted this in return for their votes,” Schneiderman said. “It’s really a cynical ploy.”
